How To Open a Dispensary In Oklahoma

On June 26, 2018, Oklahoma voters passed State Question 788 allowing for the prescribed use of medical marijuana. Because of the state’s political climate, a coalition including the Oklahoma State Medical Association, religious leaders and law enforcement agencies stood in opposition to the legislation. In the wake of SQ 788’s passing, public health advocates across the state urged regulators to enforce more strict requirements such as requiring pharmacists in each retailer, restricting the sale of smokeable products and limiting the number of dispensaries to 50 statewide.

The legislation, was officially adopted on July 10, 2018, outlines the licensing requirements for patients, caregivers and commercial licenses including dispensing, growing, processing and research. The latest revision on July 27, 2018 created a more lenient regulatory environment, allowing for cannabis to be sold in all forms and removing restrictions on THC content.

State Question 788 allows licensed patients to grow their own medical marijuana at home with up to six plants. In order to grow in your home, renters are required to have the property owner’s consent. Each patient or caregiver is allowed to purchase 3 ounces of usable marijuana, 1 ounce of marijuana concentrate, 6 mature plants and/or seedling plants per dispensary transaction.

In a fairly progressive move, Oklahoma will treat public consumption of cannabis the same as smoking tobacco outdoors.

The Oklahoma Medical Marijuana Authority will make applications for the Oklahoma Commercial Cannabis Business License available to the public sometime in August.

Application submittal and review began on August 25, 2018. The application fee will is $2,500.
