Idaho
Currently there is no authorized marijuana program in Idaho. Marijuana is considered a Schedule I hallucinogenic under the Idaho Uniform Controlled Substances Act. Despite efforts in other states, Idaho’s marijuana laws are archaic and include prosecution for possession and sales. Possession of 3 ounces of marijuana is considered a felony under this Act. The sale of marijuana can result in jail time and a hefty fine under the Act as well.

In February 2021, the Idaho Senate approved a resolution that bans possession, production, and sale of marijuana. The bill will proceed to the Idaho House of Representatives, and if passed there, will appear on the midterm election ballot. If the measure were to pass by voters, marijuana legalization would be prohibited even if voters attempt to legalize it in the future.
