Navigating the New Rules for Medical Cannabis in California

While California was the first state to legalize medical cannabis in 1996, it’s been a bumpy road for dispensaries that have been operating in a cloudy, uncertain legal environment, loosely enforced by a patchwork of local, state, and federal rules.

Governor Jerry Brown provided some long overdue clarity last week when he signed a package of bills into law that will regulate medical cannabis clinics, and establish a Bureau of Medical Marijuana Regulation to oversee the industry.


The three bills that comprise the California Medical Marijuana Regulation and Safety Act (MMRSA) include:


  • AB 266: Gives the Bureau of Medical Marijuana Regulation (BMMR) sole authority to grant and control licenses for transporting, distributing and selling medical cannabis.


  • AB 243: The Department of Food and Agriculture and other state agencies will license and regulate cannabis cultivation, and will use civil penalties and fines to enforce environmental protections.


  • SB 643: Requires the Medical Board of California to oversee and investigate physicians who prescribe cannabis, and in particular those who may have a financial stake in dispensaries.


In the coming weeks, state agencies will be establishing more detailed guidelines for local governments, law enforcement, dispensaries, cultivators, patients and health care providers. In the meantime, medical cannabis dispensaries, cultivators and processors will have to review the new rules in order to determine how their businesses will be impacted. The next step, of course, will be figuring out how to get established on the legal side of the fence.


Existing medical cannabis dispensaries that are in good standing have until January 1, 2016 to submit forms for expedited license approval.


In addition to the new medical cannabis rules, in 2016 California voters will have an opportunity to legalize cannabis for recreational use. If and when that happens, we can look forward to a whole new round of state guidelines and policies.
